General Order Discretion for Expeditors International ShipmentsDue to issues stemming from a cyberattack, CBP is exercising discretion in the issuance of liquidated damages and penalties for shipments, where Expeditors International is the Customs Broker, that do not move to a General Order warehouse within the regulatory timeframes. The purpose of this CSMS is to notify carriers, terminal operators and other custodians of unentered merchandise to exercise similar discretion in affected shipments and to prevent unnecessary cost of General Order. This guidance applies to both direct arrival into the U.S. and in-bond movement to subsequent ports. This discretion will expire upon Expeditor’s return to full automated operations. CBP will issue a notice advising of the end of the discretionary period.

Expiration of the Emergency Processes for U.S. Transit of Goods to and from British Columbia

On November 14, 2021, British Columbia (B.C.) was subject to an unprecedented “Atmospheric River” which resulted in flooding and mass wasting events in various parts of the Province. Through collaboration with partners from United States (U.S.) Customs and Border Protection (CBP) and other government departments and agencies in the U.S. and in Canada, the Canada Border Services Agency (CBSA) implemented a domestic in-transit emergency protocol to support the supply chain and emergency goods needing to move through the U.S. to reach destinations in Canada due to road closures in B.C.
The U.S. and Canada exercised a facilitative approach to these movements to ensure expedited availability of these goods during the emergency, the objective remained facilitative while not compromising safety and security for over 4,500 passages. As of December 21, 2021 all of the major routes into B.C. were restored and traffic resumed.
Based on consultations with trade chain partners and our U.S. CBP counterparts, the temporary measures developed have been allowed to expire as of March 31, 2022 at 12:01 am PDT.

Harmonized System Update (HSU) 2208 created on April 1, 2022

Harmonized System Update (HSU) 2208 was created on April 1, 2022 and contains 513 ABI records and 114 Harmonized Tariff Records.

HSU 2208 contains A Proclamation on Adjusting Imports of Steel into the United States. The United States and Japan have agreed to expand coordination involving trade remedies and customs matters, monitor bilateral steel and aluminum trade, cooperate on addressing non-market excess capacity. Additionally, HSU 2208 contains updates to the PGA Message Set. Participating Government Agency (PGA) indicators for FDA, FWS, and AMS were updated.
